I married my husband in 2012. Soon after he filed my i-130 for consular processing. Within a couple months, I started having disagreements with my husband on variety of issues. He did not cancel i-130 petition and it got approved. I asked him to give me a divorce in January 2013 on phone one day. And he stopped talking to me and started talking to an attorney about divorce action. In April, I asked him not to go thru divorce and reconcile. Sometime in May 2013, we reconciled and I got my visa stamped on the passport for CR-1 in July 2013. Then I felt I was making a mistake by continuing the relationship. I told my husband and I think his fuse short-circuited and he wrote to the USCIS and withdrew himself from the petition. After that he never contacted me. I kept on calling and emailing him but, he would not respond. So, sometime in November, i decided to come to USA. When i came here, customs put me on deferred inspection as my husband withdrew himself from the joint petition. That made me very angry and perplexed.

After whole day at the airport, I came to his place in the evening and he welcomed me home. 2 days later, I got into a big fight with him and his mother. They asked me to live in a hotel that they would pay for but, they did not want bickering inside the house. I had a parole hearing end of next month and so, I did not go stay in the hotel as they requested. On the hearing day, my husband asked me to take my belongings with me as he did not know the procedure and if customs would allow me to stay. He did not want to deal with my stuff at his place. I did not listen to him and went to the hearing. I got another date for the hearing as I was late.When I came back, my husband told me to go stay in the hotel that he had booked as he did not want to deal with constant quarelling. I went straight to the commissioner's office and got an interim protective order. The Sheriff's office sent people with me and threw my husband and mother-in-law out of the house.

In a couple days, we had the hearing on the PO and the judge denied both my petitions. I came back to my husband's place with police and they had to let me stay there. On second parole hearing I was admitted in the USA. We had a lot of bickering at home as I absolutely did not like my mother-in-law staying with us. So, I threatened my husband with more police action and him possibly losing his job if I complained. He told me that he bought the house several years before our marriage and it is true that I did not spend a penny for anything. My name is not on the title or on the mortgage. I also did not have to pay for any utility, groceries or any living expenses since I arrived in the USA. But, the house is marital property by state law and so, I have the right to live there. 7 days after I got admitted my husband and his mother moved out of their own home into an apartment somewhere by telling me that they could not live in this environment anymore. His words were, "Live in the house, exercise your rights and enjoy!"

Since then I have never heard from him or his mother. I changed the locks on the door and the mailbox also. His lawyers have asked me not to contact him or his mother directly and to contact them thru the lawyers only. Looks like he changed his contact information as well. Now, I am living in the house by myself. He pays for the mortgage and utilities still. It's his house. It's not my responsibility to pay bills for his house. I don't have my name on anything. So, if he fails to pay the bills, its his problem. I don't understand why people are so angry with me. He told me clearly that he'd not pay for the phone or TV or internet. In 2014, can anyone live without phone or interent? This is abuse. He knows I can't get them right now.

So, can I claim that my husband is abusing me by leaving me alone here? Can I claim relief under VAWA? I am told that my residency is conditional. I need to remove the conditional residency if I want to stay here as a permanent resident. Will I have problems in doing that? We stayed together in the same house for 40-45 days before he moved out. We do not have any joint accounts, leases etc. I think he will divorce me. How do I get permanent green card and stay here?

Any help or suggestion will be appreciated.
